Eversince | Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the Eversince platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Definitions

“Eversince,” “we,” “us,” or “our” refers to Eversince, an AI-powered ad creation platform operated from Israel.
“Service” refers to the Eversince platform, including our website, applications, APIs, AI-powered tools, and all related services.
“User,” “you,” or “your” refers to any individual or entity that accesses or uses the Service.
“User Content” refers to any text, images, videos, audio, brand assets, reference materials, or other content you upload, submit, or provide to the Service.
“Inputs” refers to the prompts, instructions, descriptions, and parameters you provide to our AI tools.
“Outputs” refers to AI-generated content produced by the Service, including images, videos, audio, voiceovers, music, and text.
“Commercial” refers to an ad project created within the Service, consisting of scenes, audio, overlays, and settings.
“Credits” refers to the internal currency used to access AI generation features within the Service.

2. Description of Service

Eversince is an AI-powered ad creation platform. The Service enables you to create, edit, and manage AI-generated advertisements through an interactive studio interface. Key features include:

AI-assisted video and image generation
AI voiceover and music composition
Text-to-speech and speech-to-text capabilities
An AI agent that orchestrates creative workflows through conversation
Timeline-based editing and scene management
Export and sharing of completed ads

The Service uses multiple third-party AI providers to deliver these capabilities (see Section 9).

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and “you” and “your” will refer to that organization.

4. Account Registration

4.1 Account Creation

To access most features of the Service, you must create an account. You may register using an email address and password or through Google OAuth. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@eversince.ai if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One Account Per User

Each account is intended for use by a single individual. You may not share your account credentials with others or allow multiple individuals to use a single account.

5. Credits and Payment

5.1 Credit System

The Service uses an internal credit system. Credits are consumed when you use AI generation features, including image generation, video generation, voiceover creation, music composition, and agent-assisted operations. Different features consume credits at different rates.

5.2 Credit Purchases

Credits may be purchased through the Service. All credit purchases are processed through Lemon Squeezy and Stripe, our payment providers. Prices are displayed at the time of purchase and may change at our discretion. Price changes do not affect credits already purchased.

5.3 Credit Properties

Credits have no cash value and are non-transferable between accounts. Credits are non-redeemable for cash. Purchased credit packs remain available in your account unless otherwise specified at the time of purchase or in a specific promotional offer. Subscription credits (credits included with Pro Monthly and Pro Yearly plans) reset at each billing cycle renewal — any unused subscription credits expire when new credits are granted. Purchased credit packs are not affected by this reset and remain available regardless of subscription renewals.

5.4 Subscriptions

If the Service offers subscription plans, subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription through your account settings or by contacting support. Upon cancellation, you retain access to subscription benefits until the end of your current billing period. Unused subscription credits are not carried over after cancellation or expiration of a subscription.

5.5 Refunds

All purchases are generally final and non-refundable except as required by applicable law. Refund requests may be considered on a case-by-case basis at our sole discretion. To request a refund, contact support@eversince.ai.

5.6 Failed Payments

If a payment fails, we may suspend access to paid features until the payment issue is resolved. Repeated payment failures may result in account suspension.

5.7 Referral Program

The Service may offer a referral program that awards bonus credits to both the referring user and the referred user upon qualifying actions (such as subscribing to a paid plan). Referral credits are subject to the same properties as purchased credits (Section 5.3): they have no cash value, are non-transferable, and are non-redeemable for cash. We reserve the right to modify, suspend, or terminate the referral program at any time. Abuse of the referral program — including self-referrals, fake accounts, or any fraudulent activity — may result in forfeiture of referral credits and account suspension.

6. Intellectual Property — Platform

6.1 Eversince Ownership

The Service, including its design, features, functionality, code, documentation, logos, trademarks, and all related intellectual property, is owned by or licensed to Eversince. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it as described herein.

6.2 Limited License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. This license does not include the right to:

Modify, copy, or create derivative works of the Service
Reverse engineer, decompile, or disassemble any part of the Service
Remove or alter any proprietary notices or labels on the Service
Use the Service to build a competing product or service
Sublicense, sell, resell, or redistribute access to the Service

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, and incorporate that feedback into our products and services without obligation to you.

7. User Content and Inputs

7.1 Your Ownership

You retain all ownership rights in your User Content and Inputs. By uploading or submitting User Content, you do not transfer ownership to Eversince.

7.2 License Grant to Eversince

By submitting User Content or Inputs to the Service, you grant Eversince a non-exclusive, worldwide, royalty-free license to use, process, store, reproduce, and display your User Content and Inputs solely as necessary to provide, maintain, and improve the Service. This includes transmitting your content to third-party AI service providers for processing (see Section 9).

7.3 Your Representations

You represent and warrant that:

You own or have obtained all necessary rights, licenses, and permissions to use and submit your User Content
Your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party
You have obtained consent from any identifiable individuals depicted in your User Content, including consent for AI processing of their likeness
Your User Content complies with all applicable laws and regulations

7.4 No AI Model Training on User Content

We do not use your User Content, Inputs, or Outputs to train or fine-tune AI models (i.e., adjusting the weights or parameters of a machine learning model). Your content is processed by third-party AI providers solely to generate the Outputs you request. For information about how third-party providers handle data, see Section 9 and our Privacy Policy.

We may review and analyze interactions with the Service — including chat messages, agent actions, and generation results — to evaluate, improve, and maintain the quality of the Service, including the AI agent's behavior, prompts, tools, and workflows. This is service improvement, not model training: no AI model weights are adjusted using your data.

7.5 Content Removal

You may delete your User Content from the Service at any time through your account. Upon account deletion, we will delete your User Content from our systems in accordance with our data retention practices described in our Privacy Policy.

8. AI-Generated Content (Outputs)

8.1 Ownership of Outputs

You own the Outputs generated through your use of the Service, subject to the following:

Underlying rights: Your ownership is subject to and does not override any rights of third parties in content that may have influenced the generation process.
Copyright limitations: Under current copyright law in many jurisdictions (including the United States), works generated entirely by artificial intelligence without sufficient human creative contribution may not be eligible for copyright protection. The extent to which Outputs qualify for copyright protection may depend on your jurisdiction and the degree of your creative involvement in directing and refining the Output.
No guarantee of uniqueness: AI models may generate similar or identical Outputs for different users based on similar Inputs. We do not guarantee that Outputs will be unique.

8.2 License Grant for Outputs

You grant Eversince a non-exclusive, worldwide, royalty-free license to use, store, display, and reproduce Outputs solely as necessary to provide, maintain, and improve the Service. This includes displaying Outputs within your account, enabling sharing features you initiate, and diagnostic purposes.

8.3 Commercial Use

Subject to your subscription plan and these Terms, you may use Outputs for commercial purposes, including in advertisements, marketing materials, social media, and other business communications. You are solely responsible for ensuring your use of Outputs complies with applicable laws, advertising regulations, and platform-specific policies of any distribution channel.

8.4 Shared and Exported Content

When you export or share content through the Service, it may be stored on our content delivery infrastructure and accessible via a public URL to anyone who has the link. Shared content is not indexed by search engines by default, but you should treat any shared link as publicly accessible. You are responsible for controlling who you share links with. We are not responsible for the further distribution of content once you share it.

8.5 Your Responsibilities for Outputs

You are solely responsible for:

Reviewing all Outputs before use or publication
Ensuring Outputs do not infringe third-party rights (including intellectual property, publicity, and privacy rights)
Complying with advertising standards and regulations applicable to your jurisdiction and distribution channels, including FTC guidelines on AI-generated advertising content
Disclosing the AI-generated nature of content when required by law or by the policies of distribution platforms (such as Meta, YouTube, or TikTok)
Ensuring that AI-generated content featuring synthetic voices, likenesses, or personas complies with applicable deepfake and synthetic media regulations

8.6 No Warranty on Outputs

Outputs are generated by third-party AI models and may contain inaccuracies, artifacts, unintended content, or elements that resemble existing copyrighted or trademarked works. We make no representations or warranties regarding the accuracy, originality, legality, quality, or fitness for any particular purpose of any Output.

9. Third-Party AI Services

9.1 Third-Party Providers

The Service relies on third-party AI service providers for capabilities including image generation, video generation, voice synthesis, speech recognition, AI reasoning, music composition, and web research. We may add, remove, or change providers at any time without notice. A current list of providers and the data shared with each is available in our Privacy Policy.

9.2 Data Shared with Providers

When you use AI features, certain data is transmitted to these third-party providers for processing:

Text prompts and descriptions you provide for content generation
Images and videos you upload as reference material or for AI processing
Audio streams from your microphone when using speech-to-text features
Commercial context (scene descriptions, ad parameters) shared with the AI agent

9.3 Third-Party Terms

Your use of the Service is also subject to the terms and policies of our third-party AI providers. We are not responsible for the practices, policies, or actions of third-party providers. We select providers that commit to not using API inputs for training their models under their standard API/enterprise terms, but we cannot guarantee the practices of every provider in all circumstances.

9.4 Provider Availability

Third-party AI services may experience downtime, changes in availability, or changes in functionality. We are not responsible for interruptions or changes to third-party services that affect the availability or quality of Outputs.

10. Acceptable Use Policy

10.1 Prohibited Content

You may not use the Service to create, upload, or distribute content that:

Is illegal or promotes illegal activities
Depicts, promotes, or facilitates child sexual abuse material (CSAM) or the exploitation of minors in any form
Contains non-consensual intimate imagery, whether real or AI-generated
Promotes violence, terrorism, or harm against individuals or groups
Constitutes hate speech or promotes discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
Is defamatory, harassing, threatening, or invasive of another person's privacy
Infringes the intellectual property rights of third parties
Contains deceptive or misleading claims in violation of advertising regulations
Impersonates real individuals without their consent or in a manner likely to cause harm
Creates deepfake content intended to deceive, defraud, or harm others
Generates fake testimonials, reviews, or endorsements
Spreads misinformation or disinformation designed to manipulate public opinion

10.2 Prohibited Activities

You may not:

Use the Service to develop, train, or improve AI models or services that compete with Eversince
Attempt to extract, scrape, or reverse-engineer the AI models, algorithms, or underlying technology of the Service
Use automated tools, bots, or scripts to access the Service (except through our authorized API, if available)
Circumvent rate limits, credit limits, or other usage restrictions
Share, sell, or transfer your account or credits to others
Interfere with or disrupt the Service or its infrastructure
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks

10.3 Content Moderation

We reserve the right to review, moderate, and remove any content generated through or uploaded to the Service that we believe, in our sole discretion, violates these Terms or applicable law. We may also suspend or terminate accounts that engage in prohibited activities.

10.4 Reporting

If you encounter content that you believe violates these Terms, please report it to support@eversince.ai.

10.5 Copyright Infringement Claims (DMCA)

We respect intellectual property rights. If you believe that content available through the Service infringes your copyright, you may submit a notice to our designated agent with the following information:

A physical or electronic signature of the copyright owner or authorized agent
Identification of the copyrighted work claimed to be infringed
Identification of the material claimed to be infringing, with enough detail for us to locate it
Your contact information (name, address, phone number, email)
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Send copyright notices to: support@eversince.ai with the subject line “Copyright Infringement Notice.”

We will respond to valid notices by removing or disabling access to the allegedly infringing material. Users who repeatedly infringe third-party copyrights may have their accounts terminated.

Counter-Notice: If you believe your content was removed in error, you may submit a counter-notice with: (1) your signature, (2) identification of the removed material and its prior location, (3) a statement under penalty of perjury that you believe the removal was a mistake, and (4) your contact information and consent to jurisdiction. Send counter-notices to the same email address.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal information. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
Warranties regarding the accuracy, reliability, or completeness of any Output or content generated through the Service
Warranties that Outputs will not infringe third-party intellectual property rights
Warranties regarding the availability or performance of third-party AI providers

You acknowledge that AI-generated content may contain errors, inaccuracies, or unintended elements, and you assume all risk associated with your use of Outputs.

13. Limitation of Liability

13.1 Exclusion of Certain Damages

To the maximum extent permitted by applicable law, in no event shall Eversince, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, revenue, or business opportunities
Loss of data or content
Cost of procurement of substitute services
Damage to reputation or goodwill
Any damages arising from Outputs generated through the Service

Whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, whether or not we have been advised of the possibility of such damages.

13.2 Liability Cap

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the amounts paid by you to Eversince during the six (6) months preceding the event giving rise to the liability, or (b) one hundred U.S. dollars ($100).

13.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Eversince and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service or Outputs
Your User Content or Inputs
Your violation of these Terms
Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
Your violation of any applicable law or regulation
Any claim that your use of Outputs in advertising or marketing violates applicable advertising standards or regulations

15. Termination

15.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support@eversince.ai. Upon termination, your right to use the Service ceases immediately.

15.2 Termination by Eversince

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms or applicable law
Conduct that we determine, in our sole discretion, is harmful to other users, the Service, or Eversince
Extended periods of inactivity
Failure to pay any amounts due
Legal or regulatory requirements

15.3 Effect of Termination

Upon termination:

Your license to use the Service immediately ends
We may delete your account data, User Content, and Outputs in accordance with our data retention practices described in the Privacy Policy
Any unused credits may be forfeited (except as required by applicable law)
Provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 8, 12, 13, 14, 16, and 17

15.4 Data Export

We recommend that you export any Outputs or data you wish to retain before terminating your account. We are not obligated to maintain or provide copies of your data after account termination.

16. Dispute Resolution

16.1 Informal Resolution

Before initiating any formal proceeding, you agree to first contact us at support@eversince.ai and attempt to resolve any dispute informally for at least thirty (30) days.

16.2 Jurisdiction

If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel, unless applicable consumer protection law in your jurisdiction requires that disputes be resolved in your local courts.

16.3 EU Consumer Exception

If you are a consumer residing in the European Union, nothing in this section shall deprive you of the protection afforded by mandatory provisions of the law of your country of residence, including your right to bring proceedings before your local courts.

17. General Provisions

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of laws principles. Eversince operates from Menakhem Begin Rd 121, Tel Aviv-Yafo, Israel. Subject to Section 16, you consent to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel.

17.2 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and Eversince regarding the Service.

17.3 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

17.5 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

17.6 Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet disruptions, third-party service outages, pandemics, or other force majeure events.

17.7 Notices

We may send notices to the email address associated with your account. You are responsible for keeping your email address current. Notices are considered delivered when sent via email or posted on the Service.

17.8 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

17.9 International Use

The Service is operated from Israel. If you access the Service from another jurisdiction, you do so at your own risk and are responsible for compliance with local laws. We make no representations that the Service is appropriate or available for use in any particular location.
